What is Probate?

Probate is a term used in law to describe the court process for gathering a decedent's assets, paying taxes and claims, and distributing assets to the beneficiaries in accordance with an individual’s Last Will & Testament or if without a will, in accordance with New Jersey state law. Generally probate is only necessary when a person dies with assets in his or her own name alone.


Assets in a living trust or jointly held with someone else or with a beneficiary designation do not have to go through probate in New Jersey. Probate has a mixed reputation in New Jersey, sometimes rightfully so, but not always.
